Terms and Conditions of purchase of the easyJet Fearless Flyer Course

Definitions and interpretation

"Course" means the easyJet Fearless Flyer Course staged and run by FOF Events Ltd in association with easyJet including the Ground Course, the Zoom Call and/or the Experience Flight at a specific location. 

"Tickets" means a ticket or tickets or other types of evidence (including electronic tickets) for a Course sold by Us to You for the right to attend a Course. 

Ground Course” means the educational part of the Course that is presented in a virtual format which is viewable online.

Online Course” means the version of the Ground Course that is delivered electronically via a web based browser including any Related Products.

"Zoom Call" means the live video call held online (via Zoom or any other video hosting company as notified by Us to the Participant from time to time) prior to the Experience Flight where Participants can meet the Fearless Flyer Team personnel.

"Related Products" include, but are not limited to The Captain's Commentary, Ask The Pilot, MP3 player, The Relaxation System, Advanced Psychology Programme, The PROP Technique, Support Emails.

"Cancellation" means a course where we have not been able to hold the Experience Flight.

Participant” means the person who will be attending the Course and who is subject to these terms and conditions.

Companion” means the person over the age of 18 (unless We have agreed otherwise) who will be joining the Participant for the Experience Flight only where this option is available and has been purchased. The Companion is not permitted to view the Ground Course or attend the Zoom Call unless We have specifically invited them to do so in writing. As the purpose of the Companion is to support the Participant during the Experience Flight, the Companion must be a regular, confident flyer and this must not be their first flight. 

Experience Flight” means the part of the Course that takes place in an aircraft which includes a flight that will depart and return to the same airport as detailed on the website or as otherwise advised to You for a duration of up to 1 hour with no other stops.

Airport” means the airport at where the Experience Flight will take place from.

"Gift Voucher" means a non-refundable voucher sold by FOF Events Ltd that has no alternative cash value but which can only be exchanged for a Course place (with or without a flight companion depending on the voucher type that has been purchased).

"We" means FOF Events Ltd. "Us" and "Our" shall be read accordingly.

"You" means you or the Participant or Companion or anybody who in Our reasonable opinion is acting with your authority or permission. "Your" shall be read accordingly. 

easyJet” means easyJet Airline Company Ltd. 

"Promoter" means the person firm or company staging the Course if different from Us and the Venue. 

1. Tickets

If you are buying the ticket on behalf of another person, then that person will be deemed the Participant and they also will be bound by these terms and conditions of purchase along with any Companion. All Tickets are sold subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase as purchase of Tickets constitutes acceptance of these Terms and Conditions.  It is Your responsibility to check the details of your booking at the time of purchase as if you have made a mistake it cannot always be rectified after purchase. Please check your receipt carefully and contact us immediately if there is a mistake. Your ticket does not guarantee a specified seat on the Experience Flight although We will try and facilitate special requests if appropriate. We reserve the right to request that you take a specific seat on the Experience Flight if necessary. 

2. Price and payment 

The price of the Ticket shall be the price set at the time We accept Your order. All prices set are inclusive of any applicable taxes and booking fees. No order will be accepted until We have received full payment. 

3. Delivery  

You will NOT be issued with a hard copy ticket. When you place the order you will need to select which Course You are booking and will be asked the name of the Participant (and Companion if applicable) and We will email You by return a receipt confirming the purchase. On the day of the Course, the Participant (and Companion where relevant) will be checked in by name. If you have for any reason unsubscribed to our marketing emails, in making this purchase, you agree that we can continue to email you all of the course information relating to your booking.

4. Identification

Participants and Companions will need photographic identification (i.e. a passport or photo driving licence) with them to take the Experience Flight. For other acceptable forms of identification please click here to see the easyJet policy for domestic flights.

5. Changes to Course 

Where reasonably necessary, We reserve the right to make alterations to the published Course programme including but not limited to the location, presentation format and the start times of any part of the Course.    

6. Refunds/Exchanges/Name Changes 

With the exception of bookings made by telephone which may be cancelled within 48 hours of the original booking (subject to such cancellation being notified by email to info@fearless-flyer.com and prior to the Experience Flight and further subject to the online Ground Course not having been accessed using any log in details supplied by Us) tickets (including gift vouchers which have been redeemed for a specific course) cannot be refunded, exchanged or transferred to an alternative course after purchase (or after redemption in the case of a gift voucher) unless the Experience Flight is Cancelled (subject to below) whereby, with the exception of bookings that were redeemed via a Gift Voucher, You will be entitled to claim a refund from Us in accordance with this clause. We may however, in exceptional circumstances up to 8 days prior to the date of Your Experience Flight, permit You to change your booking to a different course that is published on our website at the time of the request, at our sole discretion, and subject to a £75 administration fee.

In the event of a Cancelled Course the limit of Our liability will be no more than the price You originally paid for the ticket. Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets except, at Our discretion, where payment was made by cash.  

In the event where the Ground Course has been viewed online using the log in details we supply, but it has not been possible to operate the Experience Flight we will use reasonable endeavours to reschedule the Experience Flight to another time and/or day and notify you accordingly (subject to You having checked in for the flight in the circumstances where the flight is cancelled after the check in process).  Under these circumstances you will be permitted to change the name of a Companion free of charge, if applicable, subject to this being done no later than 72 hours prior to the rescheduled Experience Flight. If we are unable to reschedule the Experience Flight then you will be entitled to take the Experience Flight of any published Course at the time, and again, in these circumstances Companion names can be changed subject to the same aforementioned fee waiver and notice period. The terms of your booking remain unchanged as per these terms and conditions in the event of a transfer to a rescheduled Experience Flight or an alternative course. With the exception of a booking that originated from a Gift Voucher conversion, should you be unable to attend any alternative location then you will be entitled to a partial refund for the Experience Flight element of the Course which is determined as the value of a Companion seat published at the time of your booking and if your booking included a Companion then their Experience Flight cost will be refunded as well at the same value. 

In the case of bookings from a converted (redeemed) Gift Voucher where an Experience Flight has been cancelled and not rescheduled, the booking will be converted back into a full course Gift Voucher which may be exchanged (redeemed) for a future published course taking place within 12 months from the date of the cancelled Experience Flight. 

Participants (and Companions if applicable) must present themselves to the check in desk at the Airport on the day of the Experience Flight no later than 1 hour prior to the scheduled departure time to guarantee their admission on to the flight or as otherwise notified from time to time in writing. Whether the flight operates or not, we shall not be liable for any compensation or refund in the event that the Participant and/or Companion fail to check in by the specified time or have checked in but then do not take the flight for any reason whatsoever.

It is not possible to change the name of a Participant once the booking is made except in the circumstances of the Participant legally changing their name and supplying supporting evidence of the name change if requested. 

The name of Your Companion may be changed once only, up to seven days prior to the day of the Experience Flight, subject to an administration fee of £39. Notification must be made in writing to info@fearless-flyer.com.     

No refunds or exchanges shall be issued, or part thereof, in the event that a Participant and/or Companion do not complete any part of the course. Furthermore, in order for the Participant (and Companion if applicable) to take the Experience Flight, the Participant must have first  watched the full presentation of the Ground Course.  These Terms and Conditions do not and shall not affect your statutory rights as a consumer. 

7. Gift Vouchers

Gift Vouchers have no cash value, are non-refundable, non-transferable and may only be exchanged (redeemed) only for a specific published Course. The location and frequency of Courses is not guaranteed. The recipient of the Gift Voucher must be named as the Participant at the time of purchase and You must make them aware of all of the terms and conditions contained herein prior to the redemption of the voucher. Gift Voucher redemptions are subject to space on the desired Course and must be redeemed (by contacting the FOF Events office by phone or email) against a Course taking place within 12 months of purchase (unless otherwise stated on the voucher or agreed by Us in writing) and no later than 30 days prior to the start date of the chosen Course.

8. Liability 

Personal arrangements including travel, accommodation or hospitality relating to the Course which have been arranged by You are at your own risk.  Liability for the cancellation or rescheduling of a Course, or for material changes to a Course, will be limited to the refund as set forth in Section 6.   Neither We nor easyJet will be responsible for any loss, theft or damage of Your personal belongings. 

9. Cancelled/re-scheduled Courses 

In the event of a cancellation of the Course (or part thereof) We will use Our reasonable endeavours to notify You using the details You provided Us with at the time of ordering. We do not guarantee that You will be informed of such cancellation before the date of any part of the Course. It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering.

10. Pregnancy

Pregnant Participants/Companions must read the easyJet policy for expectant mothers prior to the purchase of any ticket via this link http://www.easyjet.com/en/medical-information to ensure they are entitled to take the Experience Flight.

11. Medical Conditions

All Participants and their Companions must be fit to fly and if they are in any doubt, prior to making this purchase, they must check the easyJet website on the following link http://www.easyjet.com/en/medical-information and where appropriate, consult their Doctor prior to the flight and obtain written confirmation where necessary. 

12. Children

All participants under the age of 16 must be accompanied on the Course by a full paying adult and We must be notified within 24 hours of your booking if the Participant is under 18 years of age. 

Whilst the course has been tailored to an adult audience we do not believe there is any content that would be inappropriate for children although we would suggest that the style of presentation would probably suit children aged 11 and above. However, we would leave it for parents to make their own judgement on this and would recommend they watch our short video on our home page as part of that process as this will give a good insight into the style of the course. 

Please note that bookings for Children under the age of 11 will not be accepted unless previously agreed by Us.  

13. Online Course

Access to the Online Course will be given for the pre-specified duration via a unique login to our members site (which will be sent to you via email) but only once full payment has been made. The only person entitled to view the course is the Participant.  Any Related Products included in the purchase can be either downloaded or accessed online via a web browser from the provided weblinks provided by email. We accept no liability should you not be able to access the Related Products offline. 

14. Use of details and Data Protection 

We believe that purchasing tickets via Our site is absolutely safe. We do not electronically store any of Your payment details on Our systems as these are processed directly by Our merchant provider. We will only retain Your name and contact details (and those of the Participant or Companion if that is not You) in order to that we hold the correct information to manage the Course. We will not share Your details with any other company except easyJet and any other party who will need the information in relation to the Course (e.g the Airport) or as required to do so by law. 

15. Resale of Tickets 

You may not re-sell or transfer a Ticket and we will only admit the Participant on to the Course who is named in the original purchase.  

16. Void Tickets 

Any Ticket obtained in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such Ticket shall be void. Void Tickets are non-refundable. 

17. Conditions of Admission 

We reserve the right to refuse Ticket holders admission to the Course or any part thereof in reasonable circumstances including but not limited to health and safety or licensing reasons. Admission to the Experience Flight is subject to the Participant having first fully completed a Ground Course at least one hour prior to the published check in time and failure to do this will deem the booking as cancelled with no refund applicable. A Companion may only take the Experience Flight if they are accompanying the Participant. If for any reason the Participant does not take the Experience Flight, then the Companion will not be permitted to take the flight without them. In addition, if for any reason a Companion does not take the Experience Flight after they have checked in at the airport and received their boarding card, then the Participant will not be permitted to take the flight without them. Admission to the Zoom Call is subject to the Participant being visible for the duration of the Call via a video camera attached to their device.  

We further reserve the right to request that a Participant and/or Companion leave the Course (or any part thereof) on reasonable grounds and may take any appropriate action to enforce this right. By way of example, reasons for this would include: 1) behaviour in a manner which, in Our reasonable opinion has, or is likely to affect the enjoyment of other Participants; or 2) use of threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or 3) in Our reasonable opinion is acting under the influence of alcohol or drugs. You must comply with instructions and directions given by Us, Airport personnel or easyJet personnel.  No refunds will be given where entry to the Course or any part thereof has been refused or removal from the Course is necessary, whether for health and safety reasons or due to behaviour as suggested in, but not limited to, the examples above.

Participants and their Companions are guaranteed to sit together on the Experience Flight however priority for seating will always be given to Participants in the unlikely event that there are insufficient seats available for Companions to take the flight due to an unscheduled change to an aircraft with lesser seats. In those circumstances, the Companion ticket will be deemed as Cancelled in accordance with Clause 6 with the exception that the refund value will only be the Companion element of the ticket (being the original ticket price of a Participant with Companion less the original price of a Participant only ticket).

18. Restrictions, Prohibitions and Filming

The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data during any part of the Course including but not limited to the Ground Course, the Zoom Call and the Experience Flight is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of any part of the Course in breach of these conditions shall belong to Us. We will not be liable for any loss, theft or damage to confiscated items. By attending a Course, Participants and Companions consent to filming and sound recording of themselves  which We may use (including any copies) without payment for any purpose and in any media (including but not limited to the promotion of our courses) and if You are not the Participant or Companion You must advise them of this unless You or they expressly advise Us in advance of the Course that you or they do not wish to be filmed or recorded. 

19. Copyright

The rights in the design, pictures, logos, photographs and content of the Course are owned by or licensed to FOF Events Limited. They are protected by copyright, trademarks and other intellectual property rights. You may not copy, reproduce, modify, distribute, republish, display, post or transmit any part of the Course, except where expressly granted in writing by Us. You may view or print individual pages only for your own personal use.

20. Health and Safety 

Participants and Companions must comply with all relevant statutes, safety announcements and airport and airline regulations whilst attending the Course. If You have any special requirements (including disabilities for which You require special assistance), these must be advised to Us immediately upon booking so that we can advise easyJet and the airport hosting the Experience Flight accordingly.   

21. Waiver 

If We delay or fail to enforce any of these Terms and Conditions It shall not mean that We have waived our right to do so. 

22. Assignment 

We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected. 

23. Severability 

If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply. 

24. Third Parties 

Any person, other than easyJet, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts but in this case only We, easyJet and You (or your assignees permitted hereby) have rights and obligations under this contract. 

25. Force Majeure 

For the purposes of these Terms and Conditions, "Force Majeure" means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, fire, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure. This Clause does not affect the terms of Clause 6. 

26. Amendments and variations 

We intend to rely on the written terms set out here in this document.  You should read the terms and conditions carefully before entering into the contract to ensure that they contain everything that You consider has been agreed.  If they do not then you should speak to any member of staff. After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both You and We agree and it is preferable that this is in writing. 

27. No Partnership or Agency 

Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.

28. No Warranties

The information contained within the Course is provided without any representations or warranties, expressed or implied.

Do not rely on any information contained within the Course as an alternative to medical advice, treatment or care from a medical doctor or other professional healthcare provider.

29. Entire agreement 

These Terms and Conditions and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms and Conditions or not)-other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.

30. Governing Law and Jurisdiction 

These Terms and Conditions shall be governed by and construed in all respects in accordance with English and the parties agree to submit to the exclusive jurisdiction of the English courts.
